Brothers caught allegedly stealing scrap

MILTON — The owner of an empty house on Hopewell Road called Milton police Oct. 13 after finding two brothers at the home allegedly stealing copper scrap and tools.

According to the incident report, the owner drove by the house at about 4:30 p.m. and noticed a side door was open. He'd had troubles with people breaking in since the building sustained damage in a fire, so he drove up to investigate. He saw a white Chevrolet Silverado parked out front, then called 911.

That's when he saw Terry W. Medley, 47, of Cumming allegedly walk out. When Medley realized he was spotted, he began yelling for his brother, 43-year-old Milton resident Rodney Medley, who was still in the house.

They both ran to the Silverado and tried to leave, but the home's owner parked his truck in front of them and got out. They allegedly began driving toward him, so he pulled out a 9mm Glock pistol and fired a warning shot into the air. He later said he was afraid they would hit him or pin him to his car.

Rodney Medley ran from the truck, while Terry handed over the keys and then took off after his brother into the woods. Both were later found by Milton police on Hopewell Road.

When interviewed, both Terry and Rodney allegedly admitted to being in the home to take scrap metal. Terry Medley told officers he knew the homeowner because a friend named "TJ" rented the home two years ago. The homeowner said he had met Terry Medley only in passing and didn't really know who he was.

Milton police said Rodney Medley was wanted out of Florida for larceny and Terry had a limited driving permit that prevented him from motoring anywhere besides work and home. Both were taken to Fulton County Jail, where they remained at press time.

Terry Medley was charged with aggravated assault (with the automobile), obstruction, burglary, second degree criminal damage to property, violation of a limited permit and operation of a vehicle without a current tag decal.

Rodney Medley was charged with aggravated assault, obstruction, burglary and second degree criminal damage to property.
