Proposed changes to the Unified Development Code

April 06, 2014
FORSYTH COUNTY, Ga. — The Forsyth County Planning Commission will hold a public hearing to consider a possible amendment to the Forsyth County Unified Development Code (UDC), at the Commission's regular meeting on Tuesday, April 22 at 6:30 p.m.

The purpose of the public hearing is for the public to review and comment regarding concerns about a proposed amendment to the Forsyth County Unified Development Code, Chapter 10, pertaining to non-conforming lots.

Specifically, the proposed modification would allow the protection of a property owner's non-conforming status when a lot is reduced due to the lot being condemned or sold or dedicated to an entity with the power of condemnation.

The meeting will be held in the Commissioners' Meeting Room, Suite 220 of the Forsyth County Administration Building, 110 East Main Street in Cumming.

The amendment reads as follow: "Subparagraph (C) of 10‐2.3 shall have no application if a property owner provides evidence to the Director that a use was lawful at the time of commencement of the use and that the sole basis for legal nonconformity is that the owner's lot size was reduced by way of condemnation or by sale or dedication to an entity with the power of condemnation, and that the acreage so sold, dedicated or condemned reduced the lot size such that a previously legal use became a legal nonconforming use."
