Alpharetta cop allegedly sold guns to convicted felon

FORSYTH COUNTY, Ga. — An Alpharetta Police officer with 23 years of service was arrested by Forsyth County Sheriff's Office after investigators say he sold guns to a convicted felon.

Craig A. Garner, 54, a Dawson County resident, was arrested and charged with two counts of selling guns to a felon, according to Forsyth County Sheriff's Office Maj. Rick Doyle.

"It's never easy having to arrest a law enforcement officer and as a law enforcement officer you are held to a higher standard," Doyle said. "We take every allegation seriously and it's unfortunate when it gets to a point where evidence shows that and an arrest is warranted."

The investigation was launched March 3 when the sheriff's office got a complaint that a known felon was in possession of a firearm.

Sheriff's office investigators learned that Michael D. Cummings, 44, of Cumming, who is a convicted felon, was in possession of a semi-automatic rifle and a shotgun. Cummings had charges dating back to 1996 out of Union County for burglary, false imprisonment and aggravated assault.

"Through our investigation, we learned that he acquired the weapons from an Alpharetta Police officer," Doyle said.

There were gun deals on two separate occasions, Doyle said.

Cummings was arrested on March 6 and Garner turned himself in March 7.

Cummings was charged with two counts of possession of a firearm by a convicted felon and one count of criminal solicitation.

Bond was set at $22,220 for Garner. Cummings wasn't allowed bond because he was on active probation in Gwinnett and Union counties, Doyle said.

The two men were friends and belonged to the Blue Bloods, a motorcycle club, which was founded by Garner. The club is made up primarily of police officers from around the county and is dedicated to helping injured officers and supporting the U.S. Constitutional right to bear arms.

Alpharetta Deputy City Administrator James Drinkard said Garner was brought in to the Alpharetta Public Safety director's office where the Forsyth County Sheriff notified him of the situation.

"We secured [Garner's] badge and gear and as of [March 6] he is no longer employed by Alpharetta," Drinkard said.

Drinkard said the city had no evidence any illegal activities occurred while Garner was on duty. However Alpharetta would fully cooperate with Forsyth's investigation.

Garner had some history of disciplinary actions, Drinkard said.

"But nothing like this," Drinkard said.

According to Garner's personnel file, March 6 was his first day back on the job after he was suspended for several days.

Recently Garner was demoted from lieutenant to the rank of officer for unspecified reasons.

    I simply can not understand why the Officer was terminated in this manner. Sure, he should not have sold weapons to a convicted felon - but how was he to know? Convicted Felons are not required to wear Patches or Badges on their clothing much like Hitler's Germany forced Jews and Gays be labeled (watch-out for a new law from the Georgia State Legislature), and I'm sure the Felon would have lied if asked up front, "Are you a Convicted Felon?" And wouldn't everyone scream "violation of privacy' and set off a storm of ACLU suits for using his police position to check out potential buyers. I believe this whole thing was handled wrong. I hope Garner gets a good Attorney and sticks this mess back on the Knot-Head Administrators that caused this.

    Apparently these 2 were friends and belonged to the same motorcycle club. Much will be made of their prior relationship and Garners knowledge of prior felonies. I think in the end Garner will be convicted or plea deal.

    It is almost impossible to have a so called friend that is a felon and on parole in 2 counties without knowing about it. What was Cummings going to do with these guns?! He was demoted from Lt to Reg Officer. He has poor integrity issues.

    I've read the two (2) extra comments with interest. It appears that by two co-commenters have more information than I do because they have condemned the Officer as Guilty. I have no such knowledge, therefore I humbly await the natural course of the Legal System. I surely would not want to be accused of any type of wrong deeds knowing the Jury Pool that currently exists came with a pre-conceived notion that I was guilty. And just to play the Devil's Advocate, let me state that I am a member of lots of Social, and Fraternal Organizations that have multiple members, am I suppose to know the exact content of each other member's past life and history? I don't think so. Were I to sell my Rifle to one of those members, should I be held accountable if they fail to answer honestly that they are not allowed to own or possess any type of Firearm? I'm a Life-Time member of the VFW, with many members through out America - Am I suppose to know about each member? Give the man his day in Court, and try not to be so judgmental. And if you receive a Jury Summons - please try to get out of service. Tell the Judge you already have your opinion in the matter.

    What a shame.

    It is always sad to hear of a career law enforcement officer get in trouble at this level, especially one who apparently otherwise had good intentions with the club and being a strong Second Amendment supporter. We need all those supporters we can get as the tyranny of the federal government continues to grow.

    With that said, this does not bode well as a character witness:

    "Garner had some history of disciplinary actions..."

    "March 6 was his first day back on the job after he was suspended for several days."

    "Recently Garner was demoted from lieutenant to the rank of officer for unspecified reasons."

    The jury will have to decide.

    I have firsthand knowledge of the situation, and yes, the cop is guilty as sin. He knew Garner had felony convictions and he sold him firearms anyway. This cop is a known associate of a multiple felon. Their motorcycle gang is a group of white supremacists and has many crooked police officers as members. It is a dangerous criminal organization. This disgraced police officer deserves to go to prison.

    I had the pleasure to have Mr. Garner as my neighbor for many years. He's a good neighbor, father, and he would give you the shirt of his back if you needed it. He is a 24 year public servant to our community and he deserves better treatment in my opinion. I'm saddened by this news and honestly find it really hard to believe that he committed this crime. It's a good thing we live in a country where you are innocent until proven guilty. That is the case "" right people? It's a shame he didn't get administrative leave until he had his day in court. I for one hope he will be found innocent of the charges. He's a good man and this country could use a few more like him!

I would classify being a convicted felon that belongs to a police officer motorcycle club as a secret that would NOT be shared. If I am selling a gun as a private citizen to another private citizen, (as far as I know) a background check is not required. I did sell a shotgun that I owned through the newspaper 32 years ago and I may have unknowingly sold it to a convicted felon as I did not do a background check of the buyer.
