November 06, 2012 FORSYTH COUNTY, Ga. — On Halloween, deputies came knocking at a Laurel Springs subdivision home and they were not trick-or-treating.
Forsyth County Sheriff's deputies were there to investigate a complaint for underage drinking in the 7300 block of Beaumont Terrace in Suwanee. Deputies arrested a couple accused of providing liquor to minors.
Dr. Michael K. Phelan, 52, and Julie B. Phelan, 47, were both charged with contributing to the delinquency of a minor.
The charge is a misdemeanor.
About 11:40 p.m., Oct. 31, deputies showed up to the home, according to an incident report.
Around the corner of the residence, the deputy saw a 17-year-old youth dressed in a toga outfit who was semi-conscious in the bushes.
The teen, "was covered in vomit and he appeared to be suffering from alcohol poisoning," the deputy said.
Emergency crews took the teenager to Northside Hospital Forsyth, where he was treated and later cited for underage possession of alcoholic beverage.
Two other 17-year-old males at the party admitted to deputies they had been drinking and were cited for underage consumption.
Other teens at the party tested negative for alcohol.
Both of the Phelans were arrested and taken to the Forsyth County Detention Center, where they were released about 1:45 a.m. Nov. 1 after making bond.
Michael Phelan lists his occupation as an orthodontist.
They are scheduled to appear in state court on Jan. 11, 2013.
