March 18, 2013JOHNS CREEK, Ga. – Daniel Nathan West, owner of WestTree Financial in Johns Creek, is accused of felony theft and taking more than $638,000 from a client's escrow account.
Police received a call about a possible fraud Nov. 30, 2012. The victim told them his company, CQ Constructor Inc., is a subcontractor to Enviro Agscience on a project for the Corps of Engineers. The two companies entered into an escrow agreement with Daniel Nathan West, 47, of Duluth and his company, WestTree Financial LLC, to be the escrow agent.
West was arrested Feb. 28, and taken to Fulton County Jail charged with forgery and theft. He was released later on $100,000 bond.
In October, the victim said he learned that checks he had written on the WestTree escrow account to subcontractors were returned by the bank for insufficient funds.
The victim went to West and asked him why the checks bounced.
West allegedly said the funds had been erroneously transferred to another escrow account and that money had already been spent by that client.
The victim claims West took $638,819 from his account, however West promised to return nearly $340,000 of it.
There is a pending lawsuit against West and another employee of WestTree Financial, by CQ Constructor.
